1. Introduction
Welcome to BuffBuddy ("we," "us," or "our"). By downloading or using our mobile application ("App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully. If you do not agree to these Terms, do not use the App.
2. Use of the App
- Eligibility: You must be at least 13 years old to use our App. By agreeing to these Terms, you represent that you meet this requirement.
- Account Registration: To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your account credentials.
3. User Conduct and Responsibilities
You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others. You agree not to:
- Use the App for any fraudulent or unlawful purpose.
- Upload or share any content that is illegal, harmful, or offensive.
- Attempt to gain unauthorized access to the App, other accounts, or connected systems.
4. User-Generated Content
If you submit or share content within the App, such as workout logs ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, modify, and distribute such content within the App as needed to provide and improve functionality. We reserve the right to remove User Content that violates these Terms.
5. Data Collection and Privacy
We collect and process personal data as described in our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your information as described there.
6. Intellectual Property
All content, features, and functionality within the App, including text, graphics, logos, icons, and images, are the property of BuffBuddy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content from the App without our prior written permission.
7. Third-Party Services
The App may integrate with third-party services such as Google Sign-In or Firebase. These services are governed by their own terms and privacy policies. We are not responsible for the content or practices of these third parties.
8. Updates and Maintenance
We reserve the right to modify or discontinue, temporarily or permanently, the App or any part of it without notice. We will not be liable for any modification, suspension, or discontinuation of the App.
9. Subscription Services and In-App Purchases
In the future, we may offer subscription services or in-app purchases processed through the iOS App Store or Google Play Store in accordance with their respective terms. All payments and refunds will be handled directly through these platforms.
10. Data Security
We take reasonable measures to protect your data. BuffBuddy uses Firebase's authentication and storage solutions, which include encryption practices that secure user passwords and data in transit. You are responsible for maintaining the confidentiality of your account details.
11. Limitation of Liability
To the fullest extent permitted by law, BuffBuddy and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App.
12. Indemnification
You agree to indemnify and hold harmless BuffBuddy and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.
13. Dispute Resolution
In the event of a dispute, you agree to resolve it through binding arbitration rather than court proceedings. This applies to all claims related to the use of the App, except for matters involving intellectual property rights or where arbitration is prohibited by law.
14. Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United States. Any legal proceedings related to these Terms shall be instituted exclusively in the United States.
15. Data Breach Policy
In the event of a data breach, we will notify affected users promptly and take appropriate measures to secure the data. Users will be notified via email and/or an in-app notification.
16. Children's Privacy
Our App is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal data, please contact us.
17. Changes to These Terms
We reserve the right to update or modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of this document. Continued use of the App after any changes indicates your acceptance of the new Terms.
